A high-conflict divorce comes before the children’s court (kinderrechter) as soon as one parent asks the court to decide a dispute about the children that the parents cannot settle themselves. It becomes a child protection case only when the conflict seriously threatens the child’s development and voluntary help is not enough; then the court can impose a supervision order (ondertoezichtstelling, OTS) under Article 1:255 of the Dutch Civil Code (BW).

This article explains both thresholds, the role of the Child Protection Board (Raad voor de Kinderbescherming) and your rights as a parent when a supervision order is requested.

What is a high-conflict divorce under Dutch law?

There is no statutory definition of a high-conflict divorce (vechtscheiding). The term describes parents who keep disagreeing about the children long after the separation, with repeated applications to court and arrangements that are not carried out.

The label has no legal effect, but the conflict itself does. Dutch courts accept that a child exposed to a long, unresolved parental conflict can be seriously threatened in its development, even if both parents are otherwise capable carers. That is why the children’s court can intervene under Article 1:255 BW without either parent being accused of anything else.

When does the children’s court become involved?

The children’s court is the judge within the district court (rechtbank) who deals with minors under Dutch obiteljsko pravo. It can intervene in four ways, from light to far-reaching.

Can the court break a deadlock between parents?

Yes. If parents with joint parental authority (gezamenlijk gezag) disagree, either of them can ask the court to decide under Article 1:253a BW. This covers the child’s main residence, care and contact, school choice and medical treatment.

This is the least drastic route: both parents keep authority, and the court only resolves the point on which they are stuck. If a parent repeatedly does not comply, the other parent can return to court, which can attach a penalty payment or change the arrangement.

Can one parent get sole authority?

Only in exceptional cases. Under Article 1:251a BW, the court awards sole authority if there is an unacceptable risk that the child is caught or lost between the parents without prospect of sufficient improvement within a reasonable time, or if it is otherwise necessary in the child’s interests. Joint authority remains the starting point.

An unmarried parent without authority can ask for joint authority under Article 1:253c BW. Termination of authority under Article 1:266 BW is a separate child protection measure, requested by the Board or the Public Prosecution Service, and not a remedy against a difficult co-parent.

Can the child get its own representative?

Yes. Under Article 1:250 BW, the court can appoint a special guardian (bijzondere curator) if the child’s interests conflict with those of the parents. The guardian acts only for the child and can represent it in proceedings.

On 29 May 2015 the Supreme Court (Hoge Raad) held that a minor may itself ask for a special guardian and appeal a refusal, without a parent representing it (ECLI:NL:HR:2015:1409). Children aged 12 and over are invited to be heard under Article 809 of the Code of Civil Procedure (Rv); younger children can be heard too.

Kada se izriče nalog za nadzor?

A supervision order is the most far-reaching ordinary measure. The child is placed under supervision of a certified institution (gecertificeerde instelling), which supports the family and can give written instructions; the parents keep authority, but it is limited.

What does the Child Protection Board do?

The Board investigates and advises the court. The court asks it to investigate before deciding a contested case about residence or contact, or the Board starts its own investigation after a report from a school, doctor, police or parent.

It interviews both parents and the child, contacts the school and professionals, and ends with a written report (raadsrapport) and recommendation. An application for a supervision order is made by the Board or the Public Prosecution Service.

The report weighs heavily but does not decide the case. The court must establish itself that the statutory conditions are met. In supervision orders aimed mainly at restoring contact, the Supreme Court requires demanding reasoning about why the child’s development is seriously threatened (ECLI:NL:HR:2017:766, 21. travnja 2017.).

What must be proved for a supervision order?

Article 1:255 BW sets three conditions, and all three must be met. The threshold is high because the order interferes with family life.

  • The child is seriously threatened in its development; a persistent parental conflict in which the child is caught can qualify.
  • The care the parents are willing to accept is insufficient to remove that threat.
  • Od roditelja se može očekivati da ponovno preuzmu odgovornost za brigu i odgoj unutar razdoblja prihvatljivog za dijete.

If the third condition is not met, a supervision order is the wrong instrument and termination of authority may be considered instead. Voluntary youth support (jeugdhulp) from the municipality matters for the second condition: help you actually accept can make an order unnecessary.

How long does a supervision order last?

A supervision order is imposed for at most one year (Article 1:258 BW) and can be extended each time by at most one year (Article 1:260 BW). There is no overall maximum, but every extension must be requested and justified again.

In urgent cases, the court can impose a provisional supervision order for at most three months (Article 1:257 BW), after which the parents are heard. Under Article 1:261 BW, a parent, a child aged 12 or over or the certified institution can ask the court to end the order at any time if the grounds no longer exist.

The institution can give a written instruction under Article 1:263 BW. A parent or child aged 12 or over who disagrees can ask the court to declare it void within two weeks (Article 1:264 BW). Placement outside the home requires separate authorisation under Article 1:265b BW.

What can you do when a supervision order is requested?

You have real procedural rights. You are an interested party, you can file a written defence (verweerschrift) and you can be heard.

Can you ask for an independent investigation?

Yes. Under Article 810a(2) Rv, you can ask the court to order an investigation by an independent expert in proceedings about a supervision order, out-of-home placement or termination of authority. On 5 September 2014 the Supreme Court held that a sufficiently concrete and relevant request must in principle be granted and cannot be refused merely because the court feels sufficiently informed (ECLI:NL:HR:2014:2632).

Can you see the Board’s report?

In principle yes. Under Article 811(2) Rv, the court can withhold parts of a document only exceptionally. On 8 October 2025 the District Court of Overijssel held that withholding an entire report from a father was not justified and ordered an adapted version, with only the child’s place of residence removed (ECLI:NL:RBOVE:2025:6218).

Možete li se žaliti?

Yes, to the Court of Appeal (gerechtshof) within three months (Article 358 Rv). A parent without parental authority who did not make the request is, however, not an interested party in supervision order proceedings and cannot appeal (ECLI:NL:HR:2014:2665, 12 September 2014); that parent can protect family life through a contact application under Article 1:377a BW.

How can parents prevent court intervention?

Most of what the court can impose, parents can arrange themselves, faster. Three routes help most: a concrete roditeljski plan, mediation and voluntary youth support.

A parenting plan is mandatory with a divorce petition under Article 815 Rv. Make it concrete on handover times, holidays, school and medical decisions, and how you communicate. Agreements reached in mediation can be laid down in a court order so that they are enforceable.

Contact and maintenance are legally separate. Withholding contact because maintenance is unpaid, or the other way round, is not a remedy, and courts tend to hold it against the parent who does it.

What should you check if you want the court to decide?

  • Whether you have tried to agree, for example through mediation, and can show it.
  • Exactly which question the court must decide: residence, contact, school or medical treatment (Article 1:253a BW).
  • Whether your parenting plan is concrete enough to enforce.
  • A written record of what was agreed and what actually happened, with dates.
  • Whether you are asking for sole authority, and whether the strict test of Article 1:251a BW can be met.

What should you check if a supervision order is requested?

  • Whether you have received and read the full Board report; if not, ask for it (Article 811 Rv).
  • Whether each of the three conditions of Article 1:255 BW is actually supported by facts.
  • Which voluntary help you have accepted or are willing to accept.
  • Whether to request an independent expert investigation under Article 810a(2) Rv.
  • The three-month appeal deadline after the decision.

Često postavljana pitanja

Do I keep parental authority under a supervision order?

Yes. Your authority is limited, not removed. The certified institution supports the family and can give written instructions, which you can challenge in court within two weeks (Article 1:264 BW).

Can I ask for a supervision order to end early?

Yes. Under Article 1:261 BW, a parent, a child aged 12 or over or the certified institution can ask the court to end the order at any time if the grounds no longer exist.

Does the court always follow the Child Protection Board?

No. The report carries weight, but the court must establish for itself that the statutory conditions are met and give its own reasons.

Can my child ask the court for its own representative?

Yes. A minor can ask for a special guardian (bijzondere curator) under Article 1:250 BW and appeal a refusal itself, as the Supreme Court held in ECLI:NL:HR:2015:1409.
